KEEMIA simplified joint stock with a capital of €45,734.71, whose registered office is located at 11 bis rue Rabelais, 93100 Montreuil, registered with the Bobigny Trade and Companies Register under number RCS Bobigny 341 907 236, represented by Guillaume Raguet, is committed to protecting your privacy and complying with applicable laws on the protection of personal data. This “Personal Data Protection Policy” aims to provide you with all the appropriate information allowing you to understand (i) what your rights are in terms of the processing of personal data and (ii) how your personal data is processed when you use the KEEMIA Website.

Definitions

In order to allow you to fully understand the terms used in the Policy, we reproduce below some concepts that are defined by the applicable regulations and are used in this Policy.
- ” personal data ”: any information relating to an identified or identifiable natural person; an “identifiable natural person” means a natural person who can be identified, directly or indirectly, in particular by reference to an identifier, such as a name, an identification number, location data, an online identifier, or to one or more elements specific to his physical, physiological, genetic, mental, economic, cultural or social identity;
- ” treatment ”: any operation or set of operations carried out or not using automated processes and applied to personal data or sets of data, such as collection, recording, organization, structuring, preservation, adaptation or modification, extraction, consultation, use, communication by transmission, dissemination or any other form of provision, reconciliation or interconnection, limitation, deletion or destruction;
- ” responsible for the treatment ”: the natural or legal person, public authority, service or other body which, alone or jointly with others, determines the purposes and means of processing; where the purposes and means of such processing are determined by Union law or the law of a Member State, the controller may be designated or the specific criteria applicable to his designation may be provided for by Union law or by the law of a Member State;
- ” subcontractor ”, the natural or legal person, public authority, agency or other body that processes personal data on behalf of the controller.

What data does KEEMIA process in its capacity as data controller?

KEEMIA acts as data controller in connection with the processing of personal data collected on the site and via the form that you have completed, and the exhaustive list of which you will find below:
- Your identification data: Name, First name;
- Your email address;
This status of “data controller” means that the purposes and essential means of the treatments implemented with your personal data are determined by KEEMIA.

For what purposes are the data processed by KEEMIA used and on what basis?

KEEMIA may need to collect certain information about Users.
KEEMIA respects the privacy of Users, and all personal data that the User may transmit to the Site is subject to the provisions of Law No. 78-17 of 6 January 1978, known as “Informatics and Freedoms”.
In some cases, KEEMIA may also have to use the data collected in the context of professional communications.
The person responsible for processing this data is the KEEMIA Communication Manager.
The purpose of the Site is in particular, and without this list being exhaustive, to contact Users for various information topics or answers to Users' questions.
The purpose of collecting personal data through the various forms on the Site is to:
- Recontact the people who left their contact information
- ensure commercial follow-up of companies interested in our services
- With your consent, send you KEEMIA newsletters by email.
By submitting the form and ticking the consent checkbox on the form, the User expressly consents to the processing of personal data for the purpose of managing the commercial relationship.
The data collected on the Site is intended for KEEMIA's Communication Department.
KEEMIA does not collect any personal data about the User, except those that the User has voluntarily recorded.
Some of the information requested, marked by an asterisk, is necessary to process User requests. Other information, the provision of which by the User is optional, is intended to better know Users and to improve the quality of the service offered to them.
If the User does not respond to the requested and mandatory information, KEEMIA will not be able to send him the information requested.

How long is your personal data stored for?

Your personal data is stored for a period of time depending on the purposes of the collection, namely: (i) 3 years for commercial prospecting, (ii) 10 years for contractual and legal obligations. For the management of newsletters, your data is stored until you receive an objection from you to the consent you have given us.
KEEMIA pays particular attention to destroying or anonymizing personal data that is no longer necessary for the purposes for which they were collected.

Who are the recipients of your personal data?

In order to ensure the proper functioning of the website and to assist KEEMIA in pursuing the above purposes, KEEMIA relies on products and services implemented by specialized service providers. In this context, your personal data is also processed by these specialized service providers (legally qualified as “subcontractors”), acting only on instructions from KEEMIA. These subcontractors do not determine the purposes and essential means of the processing carried out with your personal data: they process your personal data only on behalf of KEEMIA.
Certain hardware and information related to your device may also be transferred to GOOGLE in the United States for the exclusive purpose of using the reCAPTCHA mechanism.
In order to protect your personal data, KEEMIA only uses subcontractors who offer robust security and compliance guarantees. A legal act systematically regulates the relationship between KEEMIA and its subcontractors.
In order to provide you with services, it is sometimes necessary to share your personal information in other countries. This may include all countries in the European Union, as well as Iceland, Liechtenstein, and Norway (collectively referred to as the EEA) based on an adequacy decision. In the absence of an adequacy decision or appropriate guarantees outside the EEA, we will ensure that the transfer is in accordance with the data protection laws of the destination country and that all personal data is secure.

What about data protection?

KEEMIA has implemented appropriate security measures to ensure that your personal data is not accidentally lost, used or accessed in an unauthorised manner, altered or disclosed. Additionally, we restrict access to your personal data to only employees, agents, contractors, and other third parties who need that data to do their jobs. They will only process your personal data in accordance with our instructions and are required to respect confidentiality.
KEEMIA has also put in place procedures to deal with any alleged personal data breach and we will notify you and any competent supervisory authority where required by law.

What are your rights regarding the processing of your personal data?

You have the right (in the circumstances and under the conditions, and subject to the exceptions set out in any applicable law) to:
- Request access to the personal data that we process about you: this gives you the right to know if we hold personal data about you and, if so, to obtain information about and a copy of that personal data.
- Request the correction of your personal data: this gives you the right to have your personal data corrected if it is incorrect or incomplete.
- Oppose the processing of your personal data: this gives you the right to ask KEEMIA to stop processing your personal data.
- Request the deletion of your personal data: this gives you the right to request the deletion of your personal data, even when this personal data is no longer necessary for the achievement of the purposes.
- Obtain from us, without undue delay, the correction of inaccurate personal data concerning you.
- Receive the personal data concerning you that you have provided to us in a structured, commonly used and machine-readable format and transfer this data to another data controller. What is a cookie?

What are the main regulations governing the deposit and use of cookies?

- Directive 2002/58/EC of the European Parliament and of the Council of 12 July 2002 concerning the processing of personal data and the protection of privacy in the electronic communications sector (Directive on privacy and electronic communications) as amended by Directive 2009/136/EC of the European Parliament and of the Council of 25 November 2009 amending Directive 2002/22/EC on universal service and users' rights relating to electronic communications networks and services;
- Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (“GDPR”). The aim of this European regulation is to ensure a consistent and high level of protection of natural persons and to remove obstacles to the flow of personal data within the European Union. However, it leaves room for manoeuvre to the Member States of the European Union to specify its rules;
- Law No. 78-17 of 6 January 1978 relating to information technology, files and freedoms. This French law incorporates the main principles of the abovementioned regulation while providing for rights and obligations specific to France in terms of the protection of personal data, in accordance with the room for manoeuvre opened by the above-mentioned regulation. It is also this law that provides for the missions and powers of the CNIL, the National Commission for Informatics and Freedoms;
- Deliberation No. 2020-091 and No. 2020-092 of 17 September 2020 repealing Deliberation No. 2019-093 of 4 July 2019 adopting guidelines relating to the application of article 82 of the amended law of 6 January 1978 to read or write operations in a user's terminal (in particular to cookies and other tracers).

How long is the data collected through cookies processed for?

For the sake of good understanding, a distinction should be made between:
